Psychiatric disabilities are the fastest growing category of disability claims in the United States. They present unique evidentiary challenges and obstacles, and
can be just as debilitating—if not more so—than physical disabilities. Depression, Anxiety, Bipolar Disorder and other such conditions can sometimes be
hard to diagnose or prove, but not impossible. Frequently, disability insurance carriers, especially in the context of ERISA plans, will exploit such evidentiary
difficulties to deny meritorious mental disability claims which are otherwise valid, and which should legitimately be paid. The problem is exacerbated by the fact

Psychiatric disabilities are the fastest growing category of disability claims in the United States. They present unique evidentiary challenges and obstacles, and
can be just as debilitating—if not more so—than physical disabilities. Depression, Anxiety, Bipolar Disorder and other such conditions can sometimes be

Howard Spear received his BA from Yeshiva University and his JD from Yale Law School. He has been practicing in the Morris County area for many years,
heavily involved in real estate, land use, and business law. He represents commercial and residential developers and operators, has successfully prosecuted
development applications with Planning Boards and Zoning Boards of Adjustment throughout northern New Jersey, and has provided legal representation in
numerous real estate and other business transactions.
Partner R. Armen McOmber, certified by the Supreme Court of New Jersey as a civil trial attorney, has over 21 years of legal experience in land use,
zoning, and redevelopment as well as representing applicants before planning and zoning boards and litigating land use matters before the Superior Court
and Appellate Division. Appointed to represent numerous municipal entities throughout New Jersey, R. Armen McOmber understands first-hand the complexities
and nuances of local government to advise his clients effectively.
